
Terms and Conditions
1. General
These General Terms and Conditions (GTC) govern the legal relationship between the guest/customer, hereinafter referred to as the “guest,” and The Alpina Management AG as the operator of the hotels The Alpina Mountain Resort & Spa and The Alpina Lodge in CH-7064 Tschiertschen / GR, hereinafter referred to as the “hotel” (singular). For simplicity, the term “contract” is used in these GTC regardless of the type of service.
Only the terms and conditions of the hotel valid at the time of contract conclusion shall apply. Any general terms and conditions of the guest shall only apply if expressly agreed upon in writing prior to contract signing.
Should individual provisions of these GTC be or become invalid, this shall not affect the validity of the contract or the remaining provisions of the GTC. Otherwise, the statutory provisions shall apply.
2. Jurisdiction / Applicable Law
For any disputes arising from this contract, the place of jurisdiction shall be CH-7000 Chur / GR, unless another mandatory place of jurisdiction applies by law.
Swiss law shall apply exclusively to all contracts, reservations, additional agreements, and general terms and conditions. The place of performance and payment is the registered office of the hotel.
3. Definitions
Groups: For the purposes of these GTC, groups are travel groups with a minimum of more than 6 booked persons.
Written confirmations: Fax and email messages are also considered written confirmations.
Contracting parties are the guest and the hotel.
4. Subject of the Contract / Scope of Application
The contract for the rental of rooms, seminar rooms, spaces, as well as the provision of other deliveries and services, is concluded upon written confirmation by the guest or through conclusive conduct. A reservation made on the day of arrival becomes binding upon acceptance by the hotel.
Contract changes become binding for the hotel only upon (written) reconfirmation. Unilateral changes or additions to the contract by the guest are invalid. Subletting or further rental of the provided rooms, as well as their use for purposes other than accommodation, require prior written approval from the hotel.
5. Scope of Services
The scope of services is determined by the individually made and confirmed reservation of the guest. The guest has no entitlement to a specific room, unless otherwise contractually agreed.
If, despite a confirmed reservation, no rooms are available at the hotel, the hotel must inform the guest in good time and offer equivalent accommodation in a nearby hotel of comparable or higher category. Any additional costs for the replacement accommodation shall be borne by the hotel. If the guest refuses the alternative accommodation, the hotel must immediately refund any services already paid (e.g., deposits). Any further claims by the guest are excluded.
6. Duration of Use
Unless otherwise agreed, the guest is entitled to use the rented rooms from 3:00 p.m. on the agreed day of arrival until 11:00 a.m. on the day of departure. For arrivals after 8:00 p.m., the guest must inform the hotel by telephone or in writing no later than 4:00 p.m. on the day of arrival; otherwise, the hotel may freely dispose of the rooms. A room check-in counts as a full overnight stay.
If the guest vacates the room more than one hour late, the hotel may charge up to 80% of the full accommodation price (list price) for the contractual overstay. This does not establish any right for the guest to continue using the premises; the right to claim damages remains reserved. In case of late departure, the hotel also reserves the right to remove the guest’s belongings from the room and store them at a suitable location in the hotel at the guest’s expense.
7. Prices / Payment Obligation
All prices communicated by the hotel are in Swiss francs (CHF) and include statutory VAT and other taxes. The tourist tax is not included and will be charged separately.
The guest is obliged to pay the agreed or applicable prices for the room and any additional services used. This also applies to orders placed by accompanying persons or visitors. Any increase in statutory taxes after contract conclusion shall be borne by the guest. Prices in foreign currencies are indicative and will be charged at the applicable daily exchange rate. The prices confirmed by the hotel are binding.
The hotel may adjust prices if the guest subsequently changes the number of booked rooms, the hotel services, or the length of stay. Depending on the agreement or for reservations exceeding CHF 300.00, the hotel may require a 50% deposit of the total booking amount. The deposit is considered a partial payment of the agreed price. Instead of a deposit, the hotel may also request a credit card guarantee. Required advance payments must be made within four days of receiving the reservation confirmation. For short-notice bookings, the hotel requires a credit card guarantee for the full amount. For early-bird reservations, the total amount is due immediately and is non-refundable. Changes to early-bird bookings are only possible in exceptional cases upon consultation with the reservation department.
If the deposit or credit card guarantee is not provided on time, the hotel may withdraw from the contract immediately (without notice) and charge cancellation fees according to section 10 of these terms. The hotel is entitled to issue interim or final invoices at any time.
The final invoice includes the agreed price plus any additional charges for services used by the guest and/or accompanying persons. The invoice must be paid at check-out in Swiss francs in cash or by accepted credit card, unless otherwise agreed. A fee of CHF 10.00 may be charged for each reminder. Offsetting claims against the hotel is excluded.
8. Cancellation by the Hotel
Up to and including 7 days before the agreed arrival date, the hotel may withdraw from the contract without any costs.
The hotel is also entitled to withdraw from the contract at any time for objectively justified reasons through immediate written notice with immediate effect. Such reasons include, for example:

Failure to provide an agreed advance payment or security within the set deadline

Force majeure or other circumstances beyond the hotel’s control that make performance of the contract objectively impossible

Rooms booked or used under misleading or false information, e.g. regarding the guest’s identity or purpose of stay

Reasonable grounds to believe that the use of the services may endanger the smooth operation of the hotel, the safety of other guests, or the reputation of the hotel

Insolvency of the guest (bankruptcy or unsuccessful debt enforcement) or suspension of payments
-
Illegal purpose or reason for the stay
In the event of cancellation by the hotel for the above reasons, the guest is not entitled to compensation, and payment for the booked services remains generally due.
6. Duration of Stay
Unless otherwise agreed, the guest is entitled to use the rented rooms from 3:00 p.m. on the agreed day of arrival until 11:00 a.m. on the day of departure. For arrivals after 8:00 p.m., the hotel must be informed by the guest no later than 4:00 p.m. on the day of arrival by phone or in writing; otherwise, the hotel is free to dispose of the room. A check-in counts as a full overnight stay.
If the room is vacated more than one hour late, the hotel may charge up to 80% of the full accommodation rate (list price) for the additional use. This does not grant the guest any contractual right to continue using the premises; the right to claim damages remains reserved. In case of late departure, the hotel may remove the guest’s belongings and store them at an appropriate location at the guest’s expense.

Any increase in statutory taxes after contract conclusion is borne by the guest. Foreign currency prices are indicative and will be charged at the daily exchange rate. Only prices confirmed by the hotel are binding.
The hotel may adjust prices if the guest changes the number of rooms, services, or length of stay. Depending on the agreement or for bookings over CHF 300, the hotel may require a 50% deposit or a credit card guarantee. Early-bird bookings are fully prepaid and non-refundable. Changes are only possible in exceptional cases.
If payment or guarantee is not provided on time, the hotel may cancel the contract immediately and charge cancellation fees (see section 10). The hotel may issue interim or final invoices at any time.
The final invoice includes the agreed price plus additional services. Payment is due at check-out in cash or by accepted credit card unless otherwise agreed. A CHF 10 reminder fee may be charged. Offsetting claims is excluded.
8. Cancellation by the Hotel
Up to 7 days before arrival, the hotel may cancel the contract without costs.
The hotel may also cancel immediately for justified reasons, including:

Failure to pay required deposits or guarantees

Force majeure or circumstances beyond control

Misleading or false booking information
-
Risk to operations, safety, or reputation

Insolvency or payment cessation
-
Illegal purpose of stay
No compensation is owed to the guest in such cases.
9. Cancellation of Reservation / Fees
Cancellation
Cancellation requires written approval from the hotel. Otherwise, the full agreed price is due even if services are not used. In case of no-show, at least 90% of the booked services will be charged.
The decisive factor is the receipt of written cancellation (email, fax, or letter).

Applies when more than 10 persons or 10–20% of services are cancelled.
Mitigation
The hotel will attempt to resell cancelled services. If successful, cancellation fees are reduced accordingly.
10. Impossible Arrival
If arrival is impossible due to force majeure (e.g. floods, avalanches, earthquakes), the guest does not need to pay for missed nights. Proof must be provided. Payment resumes once arrival becomes possible again.
11. Early Departure / Stay / Security / Internet / Smoking
Early departure does not reduce the total price; 100% of booked services are charged. The hotel will attempt to resell unused services.
Rooms are reserved only for registered guests. Sharing requires written approval.
Room keys remain property of the hotel. Loss or damage incurs CHF 10 fee.
Free Wi-Fi is provided. Guests are responsible for their login and usage.
Smoking is only allowed in designated areas.
12. Extension of Stay
Guests have no right to extend their stay. If departure is impossible due to force majeure, the contract is automatically extended under the same conditions until departure becomes possible.
13. Group Conditions
Group rates apply only with prior agreement. Groups under 6 persons are charged individual rates.
Final participant numbers must be confirmed 7 days before arrival. Reductions are charged at 80% of agreed services. Additional guests are charged individually.
One invoice is issued to the group leader, who is fully liable.
14. Food and Beverages
All food and drinks must be purchased from the hotel unless otherwise agreed (e.g. specialty items). Corkage or service fees may apply.
15. Events / Technical Equipment
Equipment provided via third parties is at the guest’s expense and responsibility.
Use of guest-owned electrical equipment requires prior approval. The guest is liable for any damages or disturbances.
The hotel may charge for electricity use and connection fees.
Guests must obtain all necessary permits and comply with regulations. Fines are borne by the guest.
Music licensing (e.g. SUISA) is the guest’s responsibility.
16. Guest Property
Items brought by guests are at their own risk. The hotel assumes no liability except in cases of gross negligence or intent.
Decorations must meet fire safety regulations and be approved by the hotel.
Items must be removed after the event; otherwise, the hotel may dispose of or store them at the guest’s expense.
Packaging waste must be removed by the guest.
17. Liability
Hotel
The hotel is liable only for intent or gross negligence. Liability for minor negligence is excluded where legally permitted.
Guest belongings are insured up to CHF 1,000 if stored in the room or safe. Valuables should be deposited at reception.
Claims must be reported immediately; otherwise they expire.
The hotel is not liable for third-party services or theft/damage by third parties.
Guest
The guest is liable for all damage caused by themselves, companions, or participants.
Third parties
Booking agents are jointly liable with the guest.
18. Pets
Pets require prior approval and may incur a fee. Owners must supervise them.
Pets are not allowed in restaurants, lounges, event rooms, or wellness areas.
19. Lost Property
Lost items will be forwarded if ownership is clear. Shipping costs and risk are borne by the guest.
20. Additional Provisions
The hotel acts only as an intermediary for third-party services.
Claims expire according to legal limitation periods; otherwise, 6 months after departure.
Advertising or publications referring to hotel events require written approval.
